Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.)

Instructions on the Right of Withdrawal

(1) Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

  • on which you, or a third party designated by you who is not the carrier, take possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together;

  • on which you, or a third party designated by you who is not the carrier, take possession of the last item, provided that you ordered several goods as part of a single order and these are delivered separately;

  • on which you, or a third party designated by you who is not the carrier, take possession of the last partial shipment or the last item, provided that you ordered goods that are delivered in several partial shipments or separate pieces.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email).

You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online by using the appropriately designated button (“Withdraw from contract” or similar wording) on our website (www.issprotectiontrade.com). If you use this online function, we will immediately send you confirmation of receipt on a durable medium (e.g. by email), including information about the content of the withdrawal declaration and the date and time at which it was received.

You may also complete and submit the model withdrawal form or another clear declaration electronically on our website (www.issprotectiontrade.com). If you make use of this option, we will immediately send you confirmation of receipt of such withdrawal (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

(2) Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

(3) Exclusion or Early Expiry of the Right of Withdrawal

(3.1) The right of withdrawal does not apply to contracts

  • for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs;

  • for the supply of goods that are liable to deteriorate or expire rapidly.

(3.2) The right of withdrawal expires prematurely in the case of contracts

  • for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery;

  • for the supply of goods which, after delivery, have become inseparably mixed with other goods due to their nature;

  • for the supply of sealed audio or video recordings or computer software if the seal has been removed after delivery.

(3.3)

  • Please avoid damaging or soiling the goods. If possible, please return the goods to us in their original packaging together with all accessories and all packaging components.

  • If necessary, please use suitable protective outer packaging. If you no longer have the original packaging, please ensure that the goods are adequately protected against transport damage by using appropriate packaging.

(3.4)

Please note that compliance with the provisions set out in section (3.3) above is not a prerequisite for the valid exercise of the right of withdrawal.

(4) Compensation for Diminished Value in the Event of Withdrawal

In the event of withdrawal from the contract, notwithstanding Section 346(2) No. 3 of the German Civil Code (BGB), the customer shall be liable for any diminished value of the goods if such loss in value results from handling the goods beyond what is necessary to establish their nature, characteristics and functioning, and provided that we have informed the customer of their right of withdrawal in accordance with Article 246a Section 1(2), sentence 1, no. 1 of the Introductory Act to the German Civil Code (EGBGB).
